The Clock as a Liability: Delay & Schedule Risk
Almost every risk a contractor faces — a differing site condition, a late material delivery, a labor shortfall, a design gap — ultimately expresses itself as delay. That is what makes schedule risk both pervasive and central to construction claims. A project's schedule is not merely a management tool; it is the evidentiary backbone of any time-related claim. Contractors who treat it as a living, defensible record hold a decisive advantage when disputes arise.
Why the Schedule Is the Claim
Time-related claims rise or fall on the quality of the schedule behind them. A critical-path method schedule establishes the sequence and logic of the work and identifies which activities actually drive completion. When a delay event occurs, the schedule is what demonstrates whether that event affected the critical path — and therefore whether it caused compensable or excusable delay at all. A poorly maintained schedule, by contrast, can sink an otherwise legitimate claim.
A schedule is not just a plan for the work — it is the evidence you will rely on when the work goes sideways.
Keeping the Schedule Defensible
A defensible schedule is one that is baselined at the outset, updated regularly and honestly, and free of the manipulation that opposing experts love to find. That means preserving realistic logic, avoiding artificial constraints that mask float, and documenting the basis for each update. Contractors who let the schedule drift out of sync with the field — updating it only when convenient — hand the other side an easy argument that the schedule cannot be trusted.
Regular schedule health checks matter: monitoring for negative float, open-ended activities, out-of-sequence progress, and logic changes between updates. Each of these, left unexplained, becomes a vulnerability in a later claim.
Analyzing Delay: Choosing a Method
When delay becomes a claim, the method of analysis is itself a strategic choice. Windows analysis divides the project into time segments and examines how the critical path evolved across each, capturing the dynamic reality of a project as it actually unfolded. Time impact analysis, by contrast, models the prospective effect of a discrete delay event by inserting it into the schedule and measuring the projected impact.
Each method has strengths and appropriate applications, and the choice can meaningfully affect the result. Windows analysis tends to be more persuasive precisely because it reflects contemporaneous conditions rather than a hypothetical model. The most defensible approach is generally the one grounded in the actual, contemporaneous schedule record — which brings the discussion full circle to schedule discipline during the project.
Concurrent Delay and Acceleration
Two issues recur in schedule disputes. Concurrent delay — where owner-caused and contractor-caused delays overlap — is among the most contested questions in construction law, and how it is resolved often determines whether time-related damages are recoverable at all. Constructive acceleration arises when a contractor, denied a legitimate time extension, must speed up to meet an unreasonable deadline; proving it requires showing the elements clearly and, once again, tying them to the schedule record.
The through-line across all of these is documentation. Notice given on time, a schedule maintained honestly, and a delay analysis grounded in the real record are what convert a schedule problem into a recoverable claim rather than an absorbed loss.
